Homeowner forced to move house after ‘disgraceful’ neighbour damaged their house and car

A homeowner was forced to move house after his neighbours damaged his house and car, assaulting a pregnant woman in the process too.

Quizam Bibi and Mahmood Hussain denied taking part in the disorder in Lord Street in the Palfrey area of Walsall, West Midlands.

Bibi and Hussain, both of Broadway West, Fullbrook, Walsall, were convicted following a trial held recently at Wolverhampton Crown Court.

The incident took place on June 30, 2019, however the court heard how the case was delayed by the Covid-19 pandemic, Bar Council industrial action and the resulting case backlog.

The court heard Bibi was armed with a walking stick while Hussain was armed with a screwdriver during the incident, described by the judge as “disgraceful.”

Antoine Miller, prosecuting, told the court that Mahmoon Ul-Hussain, the son of Mahmood now aged 31, was present during the incident and fell in with his parents after initially appearing to attempt to restrain them.

He was seen to damage the car and behave in an “aggressive” manner.

For battery, criminal damage and possession of an offensive weapon Bibi, unemployed, and Mahmood Husain, a taxi driver, were both jailed for six moths suspended for two years. They were ordered attend 20 rehabilitation activity days and pay compensation £750 and £1,000 costs.

For criminal damage Ul-Hussain was given credit for his early guilty plea and sentenced to a 12-month community order.

Wolverhampton Crown Court ordered him to attend 10 rehabilitation activity days and pay compensation of £750. All defendants were given 12 months to pay.

Mitigating barrister Mr Notu Hoon, said Mahmood Hussain, was now a family man and had since kept out of trouble.

Sentencing them on Monday trial judge Recorder David Mason KC said the family behaved in a “dreadful” manner and said their actions resulted in the victims moving house in the aftermath of the trouble.

Recorder Mason said: “It was a disgraceful incident. I accept that a complaint was made by your daughter about one of the victims that night, but a police investigation found it was not validated.

“You went with weapons, damaging the car and more seriously that a pregnant woman was assaulted while holding a young child in her arms.

“In my judgement it wasn’t surprising that the jury convicted you. But it seems to me if I were to send you to jail it would mean financial disaster and leave you unable to pay your mortgage.

“I can just about step back from giving you immediate imprisonment by way of a custodial sentence suspended.”
